C.E.S.M. has been sentenced to two years in prison by the Provincial Court of Section number 1 in Ciudad Real for the sexual abuse of a seven-year-old minor, as well as exhibiting pornographic material. He has also received a fine of 6 euros daily for 12 months, and is prohibited from approaching the victim within 500 meters of her home or school, as well as being banned from communicating with her through any means for two years.
The court arrived at the decision, as reported by Europa Press, based on the evidence presented during the oral trial. The evidence proved C.E.S.M.’s guilt beyond reasonable doubt, which he had admitted to himself during his testimony. He acknowledged the offences leveled against him, apologized, and expressed deep remorse for his actions.
The court also considered C.E.S.M.’s payment of 50,000 euros to repair the damaged caused to the victim as a mitigating factor. The plaintiff’s request for the imposition of minimum penalties was granted.
The verdict was based on corroborating evidence provided by family members of the victim, including her father, siblings, and aunts, who confirmed the time and place of the incident, as well as the existence of a phone call made by the victim’s father. In addition, the victim’s symptoms of fear and difficulty interacting with male adults were also considered as peripheral evidence.
The court also considered a psychosocial report submitted as documentary evidence. The report concluded that the victim’s account of events was consistent with that of a person who had experienced such trauma. Based on this, the court found the evidence to be sufficient to confirm the defendant’s admission of guilt.
